1.2. The Offer is accepted by registering in the "JOL Driver" app and confirming consent to its terms. The contract on the terms of the Offer is deemed concluded from the moment of acceptance. JOL records the fact, date and version of the accepted Offer. Access to orders is granted after passing the verification described in section 4.

1.3. The Privacy Policy (https://api.jolapp.asia/legal/privacy) is an integral part of the Offer. The rights and obligations of passengers, including the bonus program rules, are set out in the Public Offer for Passengers and Senders (https://api.jolapp.asia/legal/terms), which the Driver has read.

1.4. The Offer may be accepted only by persons with full legal capacity aged 18 or over.

2. Definitions

3. The role of JOL and the Driver's status

3.1. JOL is an information service that passes details of Passengers' Orders to Drivers and enables the exchange of information while the Orders are performed. JOL is not a carrier or a delivery service, does not provide carriage or delivery services and is not a party to the contract concluded between the Driver and the Passenger when the Order is accepted.

3.2. The Driver acts independently, in their own name, at their own risk and under their own responsibility. The Offer is not an employment contract, a mandate or an agency agreement; no employment relationship arises between the Driver and JOL.

3.3. The Driver decides their own working hours, goes online and offline at their own discretion, and may accept or skip any offered Order.

3.4. JOL does not guarantee any number of Orders or level of income to the Driver.

3.5. Where the legislation of the Republic of Kazakhstan (the "RK") imposes on owners of internet platforms or mobile apps for ordering taxis obligations to admit Drivers, monitor their compliance with established requirements or interact with government bodies, JOL fulfils them, and the Driver undertakes to provide the information and documents needed for this.

4. Driver requirements and admission

4.1. The Driver must:

4.2. For verification, the Driver uploads photos of the driving licence and vehicle registration certificate to the app and enters the vehicle details. The documents are reviewed by JOL staff. JOL may request additional documents and refuse admission if the documents are inaccurate, incomplete, invalid or do not meet the requirements.

4.3. The Driver guarantees the accuracy of the information provided and undertakes to update it without delay when documents are replaced or expire or when the vehicle changes.

4.4. Orders may be performed only by the verified Driver personally and only in the vehicle specified in the profile. Transferring the Account to other persons is prohibited.

5. Couriers and delivery

5.1. Access to Orders under the "Delivery" tariff is granted by JOL staff upon the Driver's application.

5.2. To obtain delivery access, the Courier provides their individual identification number (IIN). JOL verifies the IIN and stores it encrypted.

5.3. Delivery is performed only in the territory of the RK. Documents and parcels weighing up to 20 kg that fit in a passenger car are accepted.

5.4. After accepting a delivery Order, the Courier sees the Recipient's name and phone number and the parcel description. The Courier uses this data only to perform the Order.

5.5. The Courier does not open parcels and must refuse a delivery if the parcel is obviously one of the prohibited items listed in the Public Offer for Passengers and Senders, does not match the description, is improperly packed, weighs more than 20 kg or does not fit in the car.

5.6. The Courier keeps the parcel safe from the moment of pickup until it is handed over to the Recipient specified in the Order.

6. Receiving and performing Orders

6.1. While the Driver is online, the Service shows nearby Orders with the Tariff, pickup and destination points and Price. The Driver may accept or skip an Order.

6.2. By accepting an Order, the Driver undertakes to arrive at the pickup point and perform the Order for the Price shown. The Price is fixed for the route specified in the Order.

6.3. Free waiting starts on arrival at the pickup point, and its length depends on the Tariff. After that, a per-minute waiting charge accrues and is added to the Price.

6.4. The Driver may not demand payment from the Passenger above the amount shown in the app.

6.5. The Driver may cancel the Order before the trip starts. In this case the Order returns to search and is offered to other Drivers.

6.6. While the Driver is online, the Service receives the Driver's location, including in the background, to offer Orders and show the Passenger the car's position. If the Driver is not ready to accept Orders, they must go offline.

6.7. The app may be used while driving only in compliance with the Rules of the Road.

6.8. During an active Order, the Driver can message the Passenger in the in-app chat. The Passenger's phone number is not shown to the Driver. The support chat is available during and after the Order. In an emergency, call 112.

7. Payment for Orders

7.1. The Passenger pays the Driver directly: in cash or by bank transfer to the Driver's own Payment details (Kaspi, Halyk and other banks of the RK) using the phone number or the personal payment link.

7.2. The Driver enters the Payment details in the app. They are shown to Passengers of Orders paid by transfer. The Driver guarantees that the details belong to the Driver personally and are correct.

7.3. JOL does not accept payment for Orders, does not hold or transfer Passengers' money and does not process bank cards.

7.4. After paying, the Passenger taps "I've paid". The Driver must check that the money has arrived and confirm receipt in the app in good faith. It is prohibited to confirm a payment that was not received or to deny a payment that was received.

7.5. JOL is not liable for a Passenger's failure to pay for an Order, but support assists in resolving the matter, and JOL may restrict access to the Service for a Passenger who does not pay for Orders.

7.6. The Driver issues documents confirming payment in the cases provided for by the legislation of the RK.

7.7. As of this version, JOL does not charge Drivers any fee or commission for using the Service. JOL may introduce such a fee in the future only after giving Drivers prior notice and amending the Offer. The new terms do not apply to Orders accepted before they take effect.

8. Bonus compensation

8.1. A Passenger may pay up to 30% of the Order Price with bonuses. In that case the Driver receives from the Passenger only the remaining amount, which is shown in the app.

8.2. The part of the Price paid with bonuses is compensated to the Driver by JOL. The compensation amount is credited to the Compensation balance when the Order is completed.

8.3. JOL pays the accumulated amount to the Driver's Payment details. The Compensation balance and payout history are shown in the app; the payout frequency is stated in the app or communicated by support.

8.4. JOL may withhold or cancel compensation for fictitious Orders and Orders performed using fraud or collusion with a Passenger, and may demand the return of amounts paid without grounds.

8.5. Before deleting the Account, the Driver should wait until the Compensation balance has been paid out. If an unpaid amount remains at the time of deletion, the Driver may contact support, and JOL will pay it to the details the Driver provides.

13.3. JOL is liable for the operation of the Service as an information system only if at fault and to the extent of actual damage, unless otherwise provided by the legislation of the RK.
